Rights Behind Bars represents Scott Callahan, a man in a federal prison in Ohio whose artwork was censored in violation of his First Amendment rights, in a petition for rehearing and rehearing en banc before the Sixth Circuit. The Sixth Circuit erroneously held that Callahan lacked a Bivens remedy and also that, because he lacked a Bivens remedy, he also could not obtain injunctive or declaratory relief.
